New York is no different to any other city. Accidents happen, and will always happen. However, there is no excuse for significantly increasing the potential for the accident by taking charge of a machine, propelling it forward, in and around people, while drunk. The following recently appeared in the New York press.
A MAN HITS TWO TEENAGERS WHILE DRIVING DRUNK IN BROOKLYN. HE MAY NEED A NEW YORK CAR ACCIDENT LAWYER
Kings County Police report that a drunk driver had a blood alcohol content of .132, more than twice the legal limit when he crashed into Brian Rosario and Elizabeth Lopez on West Avenue and Ocean Parkway. The two were walking to Abraham Lincoln high School; located at 2800 Ocean Parkway, Brooklyn NY 11224. Lopez suffered multiple injury including head trauma and a broken jaw bone. She was taken to Coney Island Hospital; located at 2601 Ocean Parkway, Brooklyn NY 11235. Lopez suffered a less severe injury. He was taken to Lutheran Medical Center; located at 150 55th Street, Brooklyn NY 11220; where he was treated for a broken leg. Reports do not indicate if the driver suffered an injury. He was arrested at the scene of the accident and faces numerous charges including Felony Vehicular Assault, Aggravated Unlicensed Operation of a Vehicle and Driving While Intoxicated. He was held in Kings County Supreme Court where bail was remanded.
The word accident should be applied to events that are unforseen, or avoidable. The term "accident waiting to happen" is a mis-nomer. This is an disaster waiting to happen.

There really is no logic to it...
Have you ever seen the programme "NUMB3RS"?. The programme about the maths professor who applies formulas, and calculation to what would seen random events. To try to apply a mathematical equation to a set of circumstances with the objective of predicting the next event before it has happened.
If that were possible, and that a set of equation explain events, then I'm not sure I even want to know the quadratic equation that solves the next story, as told in the New York media recently. There is a whole lot going on in the title itself..

Car Accidents do not discriminate..
Nothing can guarantee you being accident free, it would seem. Not your race, or colour, or financial situation, or even your job. It is particularly ironic, when your job is to report, and comment on news, and sometimes accidents, that you are involved personally. This report recently appeared in the New York press.
FORMER NBC ANCHOR INVOLVED IN A CRASH ON THE BRUCKNER EXPRESSWAY
Former NBC news anchor Tom Brokaw was involved in a multi-car crash on the Bruckner Expressway in the Bronx, NY. The expressways stretched from the Robert F. Kennedy Bridge to the New England Thruway. Brokaw and his wife were driving in the Bronx when the accident occurred. Police report that a SUV was trying to avoid cables on the expressway and lost control. The SUV crashed into a mail truck, which then hit the car Brokaw and his wife were driving in. The driver of the SUV suffered a fatal injury at the time of the accident. The driver of the mail truck also suffered minor injury and was taken to Westchester Medical Center for treatment. Reports do not indicate if Brokaw or his wife suffered injury during the crash or if the driver was charged with DWI.
If nothing can guarantee or freedom from accidents, or make us immune to the consequences of someone elses behaviour, do we just accept it as a fact of life. Do we just succumb to what fate has in store? Is say that accepting the inevitable, is just a lazy option. Claiming compensation should be a natural response to the effect someone else has had on your life. They should be the guilty ones for doing it. Not you feeling guilty about requesting recompense.

DRIVEN TO DISTRACTION
If everyone could see into the future, then car accidents wouldn't happen. Or would they? Maybe some people would still want an accident to happen, to avoid a greater catastophe. Accidents would still be an everyday occurrence, but we would know the consequences beforehand. Blame would be apportioned to an even greater extent, as it could be argued that it was even more avoidable. Unfortunately, instances like this report, from the New York press, may be even more regular, and than compensation claims would be even greater.

They couple was jogging along Hylan Blvd in Staten Island when The car crashed into them. Both joggers were rushed to Staten Island University Hospital where the young man was reported to have suffered chest and head injury. Unfortunately, his injury was fatal. The young woman suffered head injury as well, along with a broken ankle and leg. The driver was arrested at the scene of the accident. She was found with more than 50 prescription pills on her. We take risks of accidents every day. if we were to study statistics, then we provbably wouldnt even risk getting out of bed in the morning. Just the effort of going to work would seem like an Indiana Jones style expedition, if we considered the aspect of walking, crossing the street, driving, falling down holes etc. We take as many precautions as we can to limit those risks. Some people dont, and the result can be catastrophic. As seen in the New York press recently.

The Irony Of "ThanksGiving"
"Fate", is a concept that some people use to explain events normally provide a welcome ending. "It was fate that brought us together...", or "fate spells a name beginning with W..." or some other vague statement in the Horoscope columns. If it is an outcome that we dont welcome, then we label it with "accident". The very same event, percieved from a different perspective, is given 2 distinctly different labels. No one would label the following as fate, as it appeared in the New York press on 18th January 2010.
A FATAL HIT AND RUN DURING A HOLIDAY FOOD DELIVERY
An elderly Staten Island, NY couple was delivering food for a Thanksgiving food drive when they were struck by a passing car. Reports say that Peter and Lillian Sabados were delivering canned food to Our Lady Queen of Peace Catholic Church; located at 63 Cloister Place Staten Island, NY 10306 when the accident occurred. They were struck by a passing van while they were crossing the street. The van took off after the car accident. Both Peter and Lillian were rushed to the Staten Island University Hospital. Peter Sabados suffered a fatal injury at the time of the accident and his wife’s injury became fatal a short time after being admitted to the hospital. Police were able to locate the abandoned van a short while later and were able to track down the person responsible for the accident; a 26 year old man. Lekperic eventually turned himself in and will be facing charges of driving with a suspended license and leaving the scene of an accident. He has been held on bail in Richmond County Criminal Court. There was no DWI involved and no charges for that filed.
Fate, or accident?. The danger of feeling better by labelling fate, is to deny the potential for blame. And blame is not something that should be hushed up, or denied. Fault should be recognised, and those blighted, should be compensated.

"To The Hospital Please... Taxi Driver"
Accidents do not prejudice anyone. They do not distinguish between race, colour, gender etc, so no-one is safe. Even the most experienced person, in whatever trade or career they undertake, is prone to having an accident. A driver, whose skills are more atuned than others, whose experience is vast, can succumb to an accident. The following report appeared in the New York press on January 18th 2010.
TAXI CAB ACCIDENT CAUSES INJURY TO YOUNG GIRL.
A young female, was involved in a road traffic accident, this week. Formerly a resident of Manhattan, New York where she grew up, Alison Cassani was struck by a yellow taxi cab, whilst out walking. Now living in Rome, she was visiting New York, with her mother, during the holidays. Alison was crossing on 34th Street between Third Avenue and Second Avenue when a taxi cab struck her. She was rushed to Bellevue Hospital; located at 462 First Ave. New York, NY 10116. She suffered numerous injuries from the accident, and some where considered by the medical team to be very serious. Amongst the extent of her injuries were fractures to her ribs, pelvis and skull. She also suffered brain trauma. To date, there are no charges being filed against the driver for DWI, and authorities have not yet confirmed whether drug possession was a factor in the incident.
Outside influences can bias the risk of an accident, and the incident can be attributed to many things. However, at the end of the day, peoples actions can have consequences, and they should take responsibility for those actions. That could, and sometimes should, involve an individual claim.

Claim For Blame Again?
Accidents are the result of occurrences, that we dont want to happen. The occurrence itself is a natural course of events, however, because someone gets injured, or propert damaged, or some other consequence that is not desireable, we label it accident. Sometimes the incident is a sequence of events, where one "accident", is the catalyst for another. The following report is from New York on January 10th 2010
3 CAR COLLISION INVOVLING A WOMAN AND HER 3 GIRLS.
A female resident of Brooklyn, New York, finds herself being treated at the Brookdale University Hospital, and Medical Centre. She sustained serious injuries after being involved in a 3 car collision in east FlatBush. Her 6 year old daughter had sustained severe injuries, and is in a critical condition after the accident along with her 2 year old sister, who was also in the vehicle. Their car was impacted from the rear by an SUV on Flatland Avenue, with enough force to propel the vehicle forward into the intersection, where it was struck for a second time by another car. Reports suggest that Alcohol may have contributed to the cause, although at this time no DWI charges have been brought.
After her mother’s car was rear ended in a 3-car collision in East Flatbush 6 year old Brooklyn resident finds herself in critical condition at Brookdale University Hospital and Medical center. The 6 year old was in the car with her mother and 2 year old sister who were also injured. The women along with the 2 girls were driving east on Avenue I and stopped after they were rear ended by the SUV on Flatlands Avenue. The car struck another after they were pushed into the intersection because of the impact.
Although this looks like a case of DWI, no charges have been filed up to this point.
No, some may argue that there is always blame to be apportioned. That the guilty finger can always be pointed at someone, for either negligence, incompetence, or other factors. Lessons should always be learnt, and actions should always be accounted for. This gives individuals responsibility, and sometimes that burden has to be questioned.

Another Teenage Lesson...
This is the details of yet another tragic accident in New York. Isnt it strange how we attribute the word accident, to an event that may have someone at fault. What exactly is the "accident" in question?. was it an accident that the passengers decided to get in the car?, was it an "accident" that he lost control. On a serious note, and in no way making humour, because of the fatal nature, was it an accident that the tree grew where it did?...heres the story.
20th January 2010: A FATAL ACCIDENT HAUPPAUGE, NY. TEENAGE DRIVER KILLED.
Three teenagers decided to go on a late night drive last night, with devastating consequences. For reasons not yet understood, the driver lost control of the wheel. The report was filed by the Suffolk County Police who stated that three teenagers were involved in an "road traffic accident" around the area of Sandra Drive, Hauppage; New York. Information pieced together after the event, suggests that the teenager driving, lost complete control of the vehicle, whereupon it left the carriageway and crashed into a tree. The Suffolk County Police responded to a call, shortly after the accident ocurred, and were accompanied by the Smithtown Fire Department. The wreckage was so severe that the Firefighters had to use specialist cutting equipment, to gain access to the passengers for treatment. All three were cut free from the car, with the driver taken straight to St. Catherine’s of Siena Medical Center; located at 50 Route 25A, Smithtown, NY 11787. The extent of his injuries were such that he did not recover, and died at the Center. The two other passengers in the car were taken to Stony Brook University Medical Center to be treated for their injuries. It has not been fully determined whether Alcohol played any part in the accident, and as such no police charges of DWI have been filed of yet.
This is yet another sorry case of accidents that happen every day, and at any time. Putting these down to "accidents" sometimes takes the importance of fault out of the equation. Yes, accidents do happen, but if we do not investigate, and in some cases punish those at fault, then they will happen again and again. An accident that occurs repeatedly is more than an accident.
